types of Patents are available in China?

Patent for Invention: According to Article 2 of the Patent Law of the People’s Republic of China, an invention refers to a new technical program for a product, method or improvement thereof. A patent for invention can be either a product invention or a method invention. A product invention is an invention concerning a new product or a new substance, while a method invention is an innovation of a method of manufacturing a product or a substance, a process, etc.

Utility Model Patent: Also according to Article 2 of the Patent Law of the People’s Republic of China, utility model refers to a new technical program for the shape, structure or combination thereof of a product that is suitable for practical use. Different from invention patents, utility model patents pay more attention to practicality and practical application effects, and their degree of technical innovation is generally lower than invention patents.

Design Patent: According to the same legal provision, a design is a new design of the whole or part of a product in terms of shape, pattern or combination thereof, as well as the combination of color and shape or pattern, which is aesthetically pleasing and suitable for industrial application. Design patent mainly protects the uniqueness and aesthetics of the appearance of the product, which is different from the technical program protected by invention patent and utility model patent.

If the owner of the copyright is the legal entity, the Certificate of Registration/Business Certificates should be notarized and authenticated by the Chinese Embassy or consulate. If the owner of the copyrgiht is a natural person, we just need the Scanning copy of the passport.

Filing Documents

If you plan to file a design patent application, we need clear pictures or 3D model files of your design. For utility model patent or invention patent applications, we need technical description documents.
